How We May Use and Disclose Your Health Information

City Prime Care may use and share your health information without your written permission for the purposes below. Except for treatment, we share only the minimum information needed.
Common uses and disclosures:
- Treatment. Sharing information among our clinicians, and with specialists, labs, pharmacies and hospitals involved in your care.
- Payment. Billing your health plan, confirming coverage and obtaining prior authorization for services.
- Health care operations. Running the practice, including quality review, staff training, audits and appointment reminders.
- As required by law. Disclosures that federal, state or local law requires.
We may also share information in limited situations the law permits, such as public health reporting, preventing a serious threat to health or safety, health oversight activities, responding to court orders or subpoenas, workers' compensation claims, certain law enforcement requests, and reports to medical examiners or organ donation organizations. We may share relevant information with a family member or friend involved in your care unless you object.
We will ask for your written authorization before using your information for marketing, before selling it, and for most uses of psychotherapy notes. You may revoke an authorization in writing at any time. New York and federal law give extra protection to certain information, including HIV-related, mental health, genetic and substance use disorder treatment records.
Your Rights
When it comes to your health information, you have the right to:
- Get a copy of your records. Ask to see or receive a paper or electronic copy of your medical and billing records. We will usually respond within 30 days and may charge a reasonable, cost-based fee.
- Ask us to amend your record. Request a correction if you believe information is wrong or incomplete. If we say no, we will explain why in writing within 60 days.
- Request an accounting of disclosures. Get a list of certain times we shared your information in the six years before your request, other than for treatment, payment or operations.
- Request restrictions. Ask us to limit what we use or share. We are not required to agree, except that if you pay in full out of pocket for a service, you can ask us not to share it with your health plan.
- Request confidential communications. Ask us to contact you in a specific way, such as at a different phone number or mailing address. We will agree to reasonable requests.
- Get a paper copy of this notice at any time, even if you agreed to receive it electronically.
- Be notified of a breach that may have compromised the privacy of your unsecured health information.
To use any of these rights, contact our Privacy Officer as described at the end of this notice.
Our Responsibilities
City Prime Care is required by law to maintain the privacy and security of your protected health information. We must follow the duties and privacy practices described in this notice and offer you a copy of it. We will not use or share your information other than as described here unless you tell us in writing that we can.
If a breach occurs that may have compromised the privacy or security of your information, we will notify you within the time the law requires. Our staff receive privacy training, and access to records is limited to people who need it for their work.
We can change the terms of this notice, and the changes will apply to all information we hold about you. The current notice is available at both clinics, on this website, and as a paper copy on request.
How to File a Complaint
If you believe your privacy rights have been violated, you can file a complaint with City Prime Care, with the federal government, or with both.
To complain to us, contact our Privacy Officer through the front desk at either clinic. You can describe the problem by phone or submit it in writing, and we will look into it and respond.
You can also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights by mail at 200 Independence Avenue SW, Washington, D.C. 20201, by calling 1-877-696-6775, or online at www.hhs.gov/ocr/complaints. Complaints to the Office for Civil Rights generally must be filed within 180 days of when you knew about the problem.
We will not retaliate against you for filing a complaint. Your care, appointments and access to services will not be affected.

City Prime Care has a Privacy Officer who handles questions about this notice, requests to use your rights, and privacy complaints. To reach the Privacy Officer, call either clinic's front desk, Monday to Friday, 9 AM to 6 PM, and ask for your message to be passed on.

Some requests, such as copies of records or amendments, may need to be made in writing, and the front desk can give you the right form.
